These Terms & Conditions apply when you use www.nocturalights.co.uk or place an order with Noctura.
Please read these terms before placing an order.
Nothing in these terms affects your statutory rights as a consumer.
1. Our products
We take care to describe and photograph our products as accurately as possible.
Colours can appear slightly different depending on screens and lighting. Products made from natural materials, woven fibres, wood, printed fabrics or hand-finished surfaces may also vary slightly in colour, grain, pattern placement or texture.
We think these small differences are part of their character rather than faults.
Product dimensions are approximate unless stated otherwise.
2. Prices
All prices shown on our website are in pounds sterling (£).
Prices shown to UK consumers include applicable taxes where required.
Delivery charges are shown separately before you complete your purchase.
We may change prices from time to time, but changes will not affect orders already accepted by us.
3. Placing an order
When you place an order, you are offering to buy the products in your basket.
You will receive an email acknowledging your order. A contract between you and Noctura is formed when we accept your order and confirm it.
If we are unable to accept an order, we will let you know and refund any payment already made.
This may happen because an item is unavailable, there is an obvious pricing or description error, we cannot deliver to your location or we suspect fraudulent activity.
4. Payment
Payment must be made using one of the payment methods shown at checkout.
Payments are handled securely by our payment providers. Noctura does not retain your full payment card details.
5. Delivery
Our current delivery charges and estimated dispatch times are shown on our Delivery page and at checkout.
Unless we agree otherwise with you, goods will be delivered without undue delay and within 30 days of your order being accepted.
Occasionally circumstances outside our reasonable control may delay delivery. If this happens, we will do our best to keep you informed.
Risk in the goods passes to you when they are delivered to you or to a person you have nominated to receive them.
6. Your right to cancel
When purchasing goods online, consumers normally have a legal right to change their mind and cancel their order.
For most Noctura products, you may tell us that you wish to cancel from the time you place your order until 14 days after the day you receive the goods.
You do not need to give us a reason.
To cancel, contact us clearly stating that you wish to cancel your order. You may also use the cancellation form at the end of these terms, although you do not have to.
After notifying us, you must return the goods within 14 days.
Unless the product is faulty, damaged or incorrect, you are responsible for the cost of returning it.
7. Our 30-day returns policy
In addition to your statutory cancellation rights, Noctura offers a 30-day returns policy for eligible products.
For returns made under our additional 30-day policy, we ask that products are:
Unused
Undamaged
In resalable condition
Complete with accessories, cables, remotes and instructions
Returned in their original packaging
This additional policy does not limit your statutory consumer rights.

8. Refunds after cancellation
Where you exercise your statutory right to cancel, we will refund the price you paid for the goods and the cost of our standard delivery service.
If you chose a more expensive delivery service, we are only required to refund an amount equal to our standard delivery charge.
We may reduce a refund where goods have been handled beyond what would reasonably be necessary to inspect them and this has reduced their value.
Refunds will normally be made to the original payment method.
Where goods are being returned, we may wait until we receive the goods back or receive evidence that they have been returned before issuing the refund.
9. Faulty, damaged or incorrect goods
Products must be of satisfactory quality, fit for purpose and as described.
If an item arrives faulty, damaged, incorrect or develops a fault, please contact us at enquiries@nocturalights.co.uk with your order number and, where helpful, photographs.
Your legal rights in relation to faulty goods are separate from our 30-day change-of-mind policy and are not affected by it.
Depending on the circumstances, you may be entitled to a refund, repair or replacement.
10. Rechargeable, battery and solar products
Battery performance and charging times may vary according to the individual product, brightness setting, frequency of use, temperature, battery age and charging conditions.
Solar-light performance also varies according to the amount of daylight available, season, weather and positioning of the solar panel.
Expected performance information shown on product pages is therefore a guide rather than a guarantee that every charging cycle will produce an identical runtime.

11. Outdoor products
Only products specifically described as suitable for outdoor use should be used outdoors.
Please check the individual product’s IP rating and care instructions.
An outdoor rating does not necessarily mean a product should be permanently exposed to severe weather, frost or prolonged water exposure.
12. Intellectual property
The Noctura name, logo, website design, copy, product photography, illustrations and other original content on this website belong to Noctura or are used with permission.
You may not reproduce, distribute or commercially use our content without prior written permission.
13. Website availability
We try to keep the website accurate and available, but we cannot guarantee that it will always operate without interruption or technical errors.
We may update, change or temporarily withdraw parts of the website where reasonably necessary.
14. Our responsibility to you
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or your statutory rights relating to faulty or misdescribed goods.
We are not responsible for business losses suffered by consumers purchasing products primarily for personal or household use.
15. Events outside our control
We will not be responsible for delays or failure to perform our obligations where this is caused by events outside our reasonable control.
We will contact you where appropriate and take reasonable steps to minimise the effect of the delay.
16. Governing law
These terms are governed by the laws of England and Wales.
If you live elsewhere in the UK, you may also benefit from mandatory consumer protections that apply where you live.
